upon the Magistrate on the facts already before him to commit Sotto for extradition unless his defence (which of course has not yet been heard) discloses an answer to the facts already proved, the Full Court would probably do no more than order the Magistrate to hear and determine the case according to law which the Magistrate would do and, with his present view of the law, will merely come to
the same decision.
6. I expect you will probably hear from the United
States Authorities before long about this matter and therefore I put the case before you now so that you may be acquainted with the peculiarities of the situation. You may think it desirable to refer
the matter again to the Secretary of State pointing out the
position and asking whether under the circumstances it is desirable
that this Government should take any further steps in the matter.
